Behind on Payments? Sell Before Foreclosure
If keeping the house isn’t realistic, a quick cash sale may let you move forward on your own terms.
Falling behind on a mortgage is stressful, and the letters from your lender only make it louder. The first thing to know is that you usually have more time and more options than it feels like. The second is that waiting tends to shrink those options.
Start by calling a free HUD-approved housing counselor. They can walk you through loan modifications, repayment plans and mediation. If you decide selling makes more sense, Sax Properties can make a no-obligation cash offer, usually within 24 hours, and close in as little as 7 days. The mortgage gets paid off at closing from the sale.

This page is for you if…
- You’ve missed mortgage payments and can’t see how to catch up
- You received a notice of default or notice of intent to foreclose
- A sale date has been set or you expect one soon
- The house needs work, so listing it would take too long
- You want to protect your credit and move on with a plan
“They are a very personable, hardworking, and honest group of professionals.”
How selling to Sax makes this easier
Speed when the clock is running
You’ll usually have an offer within 24 hours. We can close in as little as 7 days, which can matter when a sale date is close.
Payoff handled at closing
The settlement company pays off your mortgage and any arrears from the sale proceeds. You don’t need cash up front.
No repairs or fees
We buy as-is, pay all closing costs and charge no commissions. There’s nothing to fix and no agent fee coming out of your equity.
Straight answers
If a sale doesn’t make sense for you, or the home doesn’t fit what we buy, we’ll tell you up front so you can focus on other options.
How foreclosure works in DC, Maryland and Virginia
Washington, DC
Most DC foreclosures happen outside of court. Your lender must send a notice of default with mediation information, and you have 30 days to return the mediation election form. You can generally reinstate the loan up to 5 business days before the sale, and there is no right to buy the home back after it’s sold.
Maryland
Maryland foreclosures go through the Circuit Court. You’ll usually get a Notice of Intent to Foreclose about 45 days after default, and you can request foreclosure mediation for a $50 fee. You can generally cure the default and reinstate up to 1 business day before the sale, and the court must ratify any sale.
Virginia
Virginia foreclosures are mostly trustee sales outside of court. For owner-occupied homes, the sale notice must be mailed at least 60 days ahead and include legal aid and housing counselor information. Virginia has no statutory right to reinstate and no right to redeem after the sale.
This is general information, not legal advice. Federal rules generally bar a lender from starting foreclosure until a loan is more than 120 days late. Talk to an attorney or a free HUD-approved housing counselor about your situation.

Common questions
Can I still sell if a foreclosure sale is scheduled?
In many cases, yes, as long as the sale closes before the foreclosure sale date and the payoff covers what you owe. Call us as early as you can so there’s time to get to closing.
Should I talk to a housing counselor first?
We recommend it. HUD-approved housing counselors are free and can tell you whether a loan modification, repayment plan or mediation could let you keep the home.
What if I owe more than the house is worth?
Then a cash sale may not cover the payoff on its own. We’ll tell you honestly if the numbers don’t work, and a housing counselor or attorney can explain other options.
Do I need to fix anything before selling?
No. We buy as-is, so you don’t need to spend money you don’t have on repairs or cleaning.
